Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Everynook iOS application (the "App") and the everynook.app website (the "Site") — together, the "Service." Everynook is operated by its developer ("Everynook," "we," "us"). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

2. The Service

Everynook is a home-inventory app: it helps you catalog belongings — photos, receipts, serial numbers, purchase details, warranty dates, locations, and values — so that record is available when you need it, such as for insurance claims, warranty service, or a move. The Site provides information about the App and an optional email waitlist.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service.

4. Your Apple ID and iCloud

The App runs on Apple devices and, if you enable sync, stores your data in your personal iCloud account using Apple's CloudKit service. Your use of iCloud is governed by your agreement with Apple. We do not operate accounts of our own and cannot access, recover, or reset data stored in your iCloud.

5. Subscriptions and billing

Some features of the App require a paid subscription. Subscriptions are auto-renewable and are purchased, billed, and managed entirely through Apple's App Store using your Apple ID. Prices are shown in the App before purchase. You can manage or cancel a subscription anytime in your App Store account settings; cancellation takes effect at the end of the current billing period. Refunds are handled by Apple under Apple's terms — we cannot issue App Store refunds directly.

6. Your content

Everything you put into Everynook — photos, receipts, item details, notes — is yours. We claim no ownership of it. You grant us only the narrow license needed to operate the Service at your request: for example, transmitting a receipt image to our parsing service when you choose to scan one. 7. Acceptable use

You agree not to misuse the Service — including attempting to disrupt it, probe or overload our systems, circumvent technical protections or usage limits, use automated tools to submit data to the Site, or use the Service for anything unlawful.

8. Intellectual property

The Service — including the App, Site, name, logo, and design — is owned by us and protected by applicable intellectual-property laws. These Terms don't grant you any right to use the Everynook name or branding.

9. Disclaimers

Everynook is a record-keeping tool, not insurance advice. We make no guarantee that any inventory, report, or export produced with the Service will be accepted by any insurer, or that it satisfies the documentation requirements of any policy, warranty program, or legal proceeding. Parsed values (such as text extracted from receipts) are suggestions that you should verify. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or USD $50. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

11. Termination

You can stop using the Service at any time by deleting the App. We may suspend or end access to the Service (or any part of it) if you violate these Terms or if we discontinue the Service; where practical, we'll give reasonable notice. Sections 6, 9, 10, and 13 survive termination.

12. Changes to these Terms

We may update these Terms from time to time. If a change is material, we'll take reasonable steps to notify you (for example, a notice in the App or on the Site). Continuing to use the Service after a change takes effect means you accept the updated Terms. The effective date above always reflects the current version.

13. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in British Columbia have exclusive jurisdiction over any dispute, and you consent to their jurisdiction.
